By accessing or using the Fomino Fresh Basket website, mobile application, or any related services (collectively, the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use our Service. These Terms apply to all visitors, users, and others who access or use the Service. We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Service following any changes constitutes your acceptance of the revised Terms.

You must be at least 18 years of age to use our Service. By using the Service, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms.

To access certain features of the Service, you may be required to create an account. You agree to: • Provide accurate, current, and complete information during registration • Maintain and promptly update your account information • Keep your password secure and confidential • Notify us immediately of any unauthorised use of your account • Accept responsibility for all activities that occur under your account We reserve the right to suspend or terminate your account if any information provided is inaccurate, false, or incomplete.

When you place an order through our Service, you are making an offer to purchase the products listed. We reserve the right to accept or decline your order for any reason, including but not limited to product availability, errors in product or pricing information, or suspected fraudulent activity. All prices are listed in Indian Rupees (₹) and are inclusive of applicable taxes unless stated otherwise. We reserve the right to change prices at any time without notice. Payment must be made in full at the time of placing an order. We accept credit/debit cards, UPI, net banking, and cash on delivery where available. In the event of a pricing error, we will notify you and give you the option to proceed at the correct price or cancel your order.

We aim to deliver your order within the selected delivery slot. Delivery times are estimates and may vary due to factors beyond our control, including traffic, weather conditions, or high order volumes. Free standard delivery is available on orders above ₹499. Delivery charges for orders below this threshold or for express/scheduled delivery options are displayed at checkout. We currently deliver to select areas. You can check delivery availability by entering your PIN code at checkout. We are not responsible for delays caused by incorrect or incomplete delivery addresses provided by you.

We stand behind the quality of our products. If you receive a product that is damaged, spoiled, or not as described, please contact us within 24 hours of delivery with photographic evidence. Eligible refunds will be processed within 5–7 business days to your original payment method. For cash on delivery orders, refunds will be issued as store credit or via bank transfer. We do not accept returns on perishable goods unless they are defective or not as described. Non-perishable items may be returned within 7 days of delivery in their original, unopened packaging.

You agree not to engage in any of the following activities: • Using the Service for any unlawful purpose or in violation of any applicable laws • Attempting to gain unauthorised access to any part of the Service or its related systems • Transmitting any harmful, offensive, or disruptive content • Impersonating any person or entity, or falsely representing your affiliation • Using automated tools, bots, or scrapers to access the Service without our written consent • Interfering with or disrupting the integrity or performance of the Service • Reselling products purchased through our Service for commercial gain without our prior written consent

All content on the Service, including but not limited to text, graphics, logos, images, and software, is the property of Fomino Fresh Basket or its content suppliers and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for personal, non-commercial purposes. You may not reproduce, distribute, modify, or create derivative works of any content without our express written permission.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described in our Privacy Policy. We take the security of your personal data seriously and implement appropriate technical and organisational measures to protect it against unauthorised access, loss, or misuse.

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any content available through the Service.

To the fullest extent permitted by applicable law, Fomino Fresh Basket and its directors, employees, partners, agents, suppliers, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, resulting from your use of or inability to use the Service. Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid to us in the 30 days preceding the claim.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will otherwise remain in full force and effect.
